Employee dismissals: fair reasons to dismiss

Employment

In order for a dismissal to be fair you must be able to show that you have:

  1. A fair reason to dismiss and
  2. Have followed a fair process in reaching your decision.

This Business Guide (BG) is designed to give you an overview of the potentially fair reasons in law to dismiss an employee, together with summary guidance on procedures to follow in order to reduce risk of unfair dismissal claims.  We recommend you read all BGs mentioned  in this document.

Dismissal is a complex area of law with many pitfalls along the way.  It is therefore important to contact CallFirst on 0370 845 8458 in the first instance and speak with one of our employment advisers.  You should always seek legal advice if you are contemplating dismissing an employee and prior to taking any action.
